SMETHPORT — The trial for Anthony Fenton, accused in the death of Tammy Prosser in 2021, has been scheduled to begin May 28 in McKean County Court.
Fenton, 39, has been incarcerated without bail since his arrest May 10, 2021, charged at first with aggravated assault, simple assault and recklessly endangering another person, with a charge of criminal homicide added after Prosser’s death May 12, 2021.
Fenton, 39, is accused of assaulting Prosser on May 10, 2021, in their Main Street, Bradford, apartment, which led to her death two days later at Erie County Medical Center in Buffalo, N.Y. While Fenton alleged that Prosser fell down the stairs, emergency responders said the injuries didn’t indicate that, as bruising on her body matched the sole of Fenton’s boot, the criminal complaint alleged.
Fenton had called 911, saying that Prosser was unconscious and needed immediate help. Police responded with paramedics. Prosser was on the floor between the bed and the wall and showed no signs of life, according to testimony at the preliminary hearing. She was taken to Buffalo, where she died May 12, 2021.
The trial is scheduled to last five to seven days. Fenton is represented by Public Defender Phil Clabaugh.
