SMETHPORT — The conviction of a Kane woman on multiple gun violations has been upheld by the state Superior Court.
Marily Woodford-McMahon, 63, was convicted at jury trial in 2023 on charges including possession of a firearm with an obliterated serial number, three counts of receiving stolen firearms, three counts of receiving stolen stolen crossbows, two counts of possessing offensive weapons – sawed off shotguns, and possession of drug paraphernalia.
She was sentenced to 39 months to 108 months in state prison, and had filed an appeal, claiming insufficient evidence to convict her of the charges, explained District Attorney Stephanie Vettenburg-Shaffer.
By opinion dated Nov. 14, the Superior Court affirmed her conviction, noting the evidence proved her guilt beyond a reasonable doubt. The court noted the location of the weapons found, which were in her bedroom, under her bed, and in her closet and among her personal possessions including her clothes and marijuana she claimed was hers; her “implausible and shifting” statements to police first disclaiming any knowledge of the weapons at all and then admitting she touched one of them; and the close proximity between the date some of the items were stolen and the date state police searched her residence and found them.
