SMETHPORT — An Eldred man is in McKean County Jail for allegedly trashing a commercial garage in January, and setting fires inside it.
James Funicello, 51, of 466 Windfall Road, is charged with arson with intent to destroy an unoccupied building, a second-degree felony; criminal mischief — damage property, a third-degree felony; and summary offenses including dangerous burning, criminal mischief and simple trespassing.
According to the criminal complaint, at about 9 p.m. Jan. 3, state troopers were dispatched to West Eldred Road to check on Funicello as it was reported he was having a “mental breakdown.” Three troopers arrived on the scene and found him at a neighboring property, Six Star Auto, intoxicated and not making sense, the complaint stated.
While on the scene, a trooper interviewed Funicello’s son, who said his father broke items inside the garage. The trooper went in the shop and discovered the shop to be “a complete mess, multiple tables and tool workbenches overturned, damage to a 1965 Chevrolet Impala and several items in the shop had been burned,” the complaint stated.
At about 4 a.m. the next day, residents of another nearby property contacted police to report damage to a vehicle. Troopers went back to the scene, and the residents showed police a surveillance camera that showed Funicello coming onto their property and causing damage to their truck and entering a detached garage, the complaint stated.
The damages at Six Star Auto included $1,115 to repair the damage to the shop itself, $4,560.44 to repair the contents plus the $1,000 deductible, $2,518.69 for the time needed for the extensive cleanup required before the shop could return to normal business and $6,766.98 for damage to the Impala, the complaint stated.
Funicello was arraigned Saturday before District Judge Bill Todd and remanded to jail in lieu of $20,000 bail. He is scheduled for Central Court on Thursday.
