Velveeta’s microwaveable mac and cheese advertises it takes three and a half minutes to make.
Though a woman in Florida disagrees, arguing that Kraft’s mac and cheese take longer to make. Hence, she’s suing Kraft for $5 million for false advertising, according to court documents.
Amanda Ramirez’s lawyers filed the lawsuit with the US District Court for the Southern District of Florida on Nov. 18, the complaint confirmed.
Ramirez’s lawsuit claims the packaging saying the single-serve cups of mac and cheese will be “ready in 3½ minutes” is “false and misleading,” CNN reported.
While the single-serve cups say the mac and cheese will be ready in 3½ minutes, her lawyers argue the packaging does not factor in the four steps. These steps are: “removing the lid and sauce pouch, adding water, microwaving, and stirring,” according to the court documents, as CNN reported.
Nevertheless, Kraft Heinz Foods Company called the lawsuit “frivolous” in a statement.
“We are aware of this frivolous lawsuit and will strongly defend against the allegations in the complaint,” a Kraft Heinz Foods Company spokesperson told CNN on Monday.
The attorneys called out the company for selling the product at “a substantial price premium,” arguing the advertising of ready in 3½ minutes,” “instantly catches the eye of all reasonable consumers.”
