A trial for a Bradford man accused in a 2018 crash in Duke Center that killed one person and injured several others is scheduled for August.

Daniel W. Oaks II, 34, who was the driver in the one-vehicle crash, faces charges including homicide by vehicle, involuntary manslaughter and aggravated assault by vehicle. Prosecutors allege that it was the speed of Oaks’s car that caused the damage and injuries.

Jury selection is scheduled to begin Aug. 23 in McKean County Court, and five days have been set aside for the trial.

On Sept. 8, 2018, a car driven by Oaks left the roadway near 610 Main St., Duke Center, striking multiple vehicles and a porch.

His passenger, Alyssa Hawk, 28, died. Several others — Oaks and bystanders Cody and Sam Pearce and Justin McDivitt — suffered serious injuries.

The defense claims there was a mechanical issue with the car at the time of the crash. Defense attorney Anthony Clarke, who represents Oaks, has indicated his plan to bring in an expert to testify on the point.

Oaks was arraigned on the charges on March 26, 2019.

At a hearing in January 2020, Clarke and District Attorney Stephanie Vettenburg-Shaffer were discussing some of the pending trial issues so the trial dates could be scheduled.

However, the process of scheduling the trial was interrupted by the pandemic, as all trials in McKean County were delayed for several months in order to keep everyone safe.

Court records indicate that Oaks is free, having posted bail. He posted 5% of $100,000 bail.
