A former Smethport man has pleaded guilty in McKean County Court to charges from a 2013 rape case.

John F. Brown Jr., 41, was first convicted in the case in 2013, but the case has since been overturned.

On Oct 30, 2013, a jury found Brown guilty of five charges: rape-forcible compulsion and criminal attempt-rape-forcible compulsion, first-degree felonies; indecent assault-forcible compulsion, a first-degree misdemeanor; and simple assault and indecent assault without consent, second-degree misdemeanors.

On Jan. 17, 2014, he was sentenced to eight to 22 years in state prison.

While he served that sentence, attorneys filed multiple appeals and post conviction collateral relief petitions on his behalf.

Then, in 2020, the conviction was reversed. The case was set to be scheduled for retrial.

Instead, Brown entered a guilty plea to four of the five charges of which he was originally convicted.

According to court records, Brown pleaded guilty on Tuesday to all but the misdemeanor indecent assault charge.

The case docket shows that Brown went through at least five defense attorneys during the course of the case — Douglas Garber, James Miller, Robert Kinnear, Christopher Martini and, now, Greg Henry — and Brown filed some documents pro se.

No sentencing date is set. Brown is currently incarcerated in the State Correctional Institution-Forest.

Court records filed at the time of Brown’s arrest stated that on June 20, 2013, the female victim and her three children — ages 2, 6 and 8 — were outside their home, when Brown showed up uninvited and pulled her inside the home’s mud room. She tried to get up, and he slammed her head on the floor.

There was some struggle, and he pulled her to her feet, forced her into the bedroom, threw her on the bed, got on top of her, choked her — causing her to lose consciousness — then when she regained consciousness, raped her, court records had alleged.
