CHARGES AGAINST
OLEAN, N.Y., WOMAN IN FATAL CRASH BOUND TO COURT
Criminal charges against an Olean, N.Y., woman accused in a fatal crash in January in Ceres Township were bound to McKean County Court.
Ryan Frair, 24, died in the crash.
The charges against Tifany M. Prescott, 28, were bound at a preliminary hearing Monday before District Judge William Todd.
Prescott is charged with homicide by vehicle while DUI and aggravated assault by vehicle while DUI, second-degree felonies; homicide by vehicle and accidents involving death or injury while not licensed, third-degree felony; involuntary manslaughter, a first-degree misdemeanor; DUI-alcohol, DUI-general impairment and possession of a small amount of marijuana for personal use, misdemeanors; and several summary charges.
According to the criminal complaint, at 1:45 a.m. Jan. 3, on Route 44 in Ceres Township, a Dodge Nitro sport-utility vehicle driven by Prescott was traveling west at a high rate of speed when it went out of control on a left-hand curve. The SUV went off the right side of the road and struck a concrete barrier with its passenger side.
After hitting the concrete barrier, the SUV rotated clockwise about 180 degrees and came to rest facing north, police said.
Frair, who was not wearing his seatbelt, was ejected from the vehicle. Meanwhile, Prescott, who was wearing her seatbelt, suffered suspected minor injuries and was transported to Olean General Hospital for treatment, police reported.
Police said Prescott’s blood-alcohol content was .157%; the legal limit is .08%. Prescott was found to be in possession of a small amount of marijuana, did not have a driver’s license and had obstructions — three surgical masks — hanging from the rear view mirror.
Prescott is in McKean County Jail in lieu of $60,000 bail. She is represented by the McKean County Public Defender’s office.

TURTLEPOINT MAN PLEADS GUILTY TO HARASSMENT
A Turtlepoint man pleaded guilty to one charge Monday before District Judge William Todd, while a more serious charge was withdrawn.
Kenneth E. Baker, 59, entered the plea to charge of harassment. A charge of terroristic threats was withdrawn.
Court records filed at the time of his arrest alleged that he threatened a neighbor on Jan. 13.
