Bradford man accused of indecent assault
A Bradford man is facing allegations that he had indecent contact with a woman while she was sleeping.
Bradford City Police reported that on Wednesday they transported Kyle J. Everly, 24, of Bradford, back to McKean County from Cattaraugus County (N.Y.) Jail for charges relating to the alleged sexual assault of a woman on Sept. 28.
Everly was arraigned Wednesday before District Judge Richard Luther on charges of aggravated indecent assault-complainant is unconscious or unaware, a second-degree felony; indecent assault-person unconscious, a first-degree misdemeanor; and summary harassment.
The criminal complaint states that about 10:15 p.m. Sept. 28 at a gathering, the woman had gone outside to get something out of a vehicle, and when she and Everly were walking back, he grabbed her buttocks.
She said, “Kyle Don’t!” the complaint stated, and he responded, “Oh I didn’t realize you didn’t want me to.”
She went to bed around midnight alone on a couch, and woke up to find a person — Everly — inappropriately touching her, according to court records. She pushed him away and kicked him, saying, “I thought I told you No!” Everly replied, “I just want to cuddle.”
She went back to sleep and awoke around 7 a.m. because she felt something wet on her shirt and saw Everly standing over her on the couch.
Everly is in McKean County Jail in lieu of $50,000 bail. A preliminary hearing is set for Oct. 21.

Bradford man facing firearm, drug charges
A Bradford man is facing firearm and drug charges after a traffic stop Tuesday evening on U.S. Route 219.
Seth A. James, 23, of Bradford, was arraigned Tuesday before District Judge David Engman on charges of firearms not to be carried without a license, a third-degree felony; DUI-controlled substance, a first-degree misdemeanor; marijuana-small amount for personal use and possession of drug paraphernalia, misdemeanors; and summary charges of operating a vehicle without required financial responsibility, exceeding 55 mph by 18 mph and careless driving.
According to the criminal complaint, at 5 p.m. Tuesday, a state trooper was patrolling Route 219 near the intersection of Tuna Cross Road, Foster Township, when he saw a pick-up truck traveling south at a high rate of speed and found the truck was traveling 73 mph.
The trooper pulled over the truck, driven by James, and noticed a strong odor of marijuana. James admitted that he had marijuana in his vehicle, that he smoked about four hours prior and that he did not have a medical marijuana card. When the trooper conducted impairment tests, James allegedly showed signs of impairment.
The trooper searched the vehicle and allegedly found a small amount of marijuana and a metal grinder with suspected marijuana residue. Also, under the driver-side seat he found a loaded .45 caliber Zig PC 1911 handgun with one round in the chamber; James does not have a valid concealed carry permit, court records stated.
James was released on $10,000 unsecured bail, and a preliminary hearing is set for Oct. 21.
