Stalking charges against a Port Allegany man accused of knocking on neighbors’ doors at all hours have been dismissed, but he will still face charges including allegedly offering a neighbor money for sex.
Dana R. Caston, 58, of 311 E. Arnold Ave., Apt. 5, had four counts of stalking dismissed at a hearing Monday before District Judge Bill Todd in Smethport. Bound over to court were the following charges: one count of promoting prostitution, a second-degree misdemeanor; two counts of loitering and prowling at night time, and four counts each of disorderly conduct-unreasonable noise, disorderly conduct-hazardous or physically offensive condition and harassment, all third-degree misdemeanors; and eight summary counts of harassment and one summary count of public drunkenness.
According to the criminal complaint, on June 2, Port Allegany Borough Police were dispatched to 311 E. Arnold Ave. to check on an intoxicated male — Caston — who had fallen several times. He was escorted to his apartment.
Investigation revealed that Caston had knocked on a neighbor’s door at 7:30 a.m. Saturday and offered her $100 to have sex with her, the complaint stated. She said no, told him to leave her alone and tried to close the door; however, Caston allegedly put his foot in the door so she could not close it. It took her several tries before she was able to close the door.
In fact, Caston had been outside the female’s door numerous times, knocking on her door trying to get her to answer, including one morning when he knocked six or seven times at 2:30 a.m., “mumbling and slurring his words,” the complaint stated. About 9 a.m., Caston went to the female’s door saying he was sorry and “he was not in his right mind” and was intoxicated. This allegedly happened about 16 times.
Police learned that during the two or three weeks prior, Caston had been knocking on other neighbors’ doors at all hours.
Caston remains incarcerated in McKean County Jail in lieu of $20,000 bail.
Endangerment charges against Turtlepoint man bound to court
Charges including endangering the welfare of a child were bound to court by District Judge Bill Todd at a hearing Monday.
Mervin L. Martin, 73, of 114 Plunkett Hollow Road, is charged with two counts of endangering the welfare of a child, first-degree misdemeanors; and two counts of recklessly endangering another person, second-degree misdemeanors.
According to the criminal complaint in his case, on March 24, Martin allegedly allowed two 9-year-old children to handle a loaded shotgun, and to point it at a person.
Martin remains free on $5,000 unsecured bail.
