A Kane man who was a driver in a two-vehicle accident that injured two people is facing criminal charges.
Leland H. Baker, 35, of 545 Hacker St., Kane, was arraigned Tuesday before District Judge David Engman on two counts of accidents involving death or personal injury while not properly licensed, one count a third-degree felony and the other a second-degree misdemeanor; and the following summary charges: tire equipment and traction surfaces, registration and certificate of title required, unauthorized transfer or use of registration, drivers required to be licensed, driving while operating privilege is suspended or revoked, required financial responsibility, driving on the right side of roadway, driving vehicle at safe speed and operation of vehicle without official certificate of inspection.
According to the criminal complaint, around 6 p.m. on April 17, Lewis Run-based state police responded to a crash on Route 321 north of 5 Mile Road in Wetmore Township.
At the scene, police learned that a vehicle driven by Baker had been traveling north on Route 321, when it failed to stay in the northbound lane, striking a vehicle head-on that was traveling south in the southbound lane. Baker told police he was unable to control his vehicle or stop when he tried, the complaint stated.
One passenger from each vehicle was transported to UPMC Kane for evaluation. Both were injured, and the passenger from the southbound vehicle suffered serious injuries, court records indicated.
According to the complaint, police learned that Baker’s license is suspended. Baker also related to police that the vehicle he was driving was not registered or insured, and it displayed the wrong registration plate — a plate from New York state with a status of “surrendered: plates destroyed.” The vehicle did not have a valid inspection, and his tires lacked adequate tread, too.
Baker is free on $10,000 unsecured bail, and a preliminary hearing is scheduled for June 29.
