SMETHPORT — A Port Allegany man will be serving 6 to 12 years in state prison for gun and drug charges.
Donald F. Green Jr., 59, was sentenced Thursday in McKean County Court. On Oct. 21, a jury found him guilty of charges of possession of a firearm prohibited, possession of drug paraphernalia and possession of a controlled substance.
Green has credit for 238 days of time served.
Court records filed at the time of Green’s arrest alleged that troopers searched his home with his permission and allegedly found marijuana, mushrooms, paraphernalia, money, four long guns and one handgun. He is not allowed to possess firearms because he is a convicted felon.
Also in court, Josh J. Bodistow, 35, of Kane, was sentenced to three months to two years in state prison for a charge of recklessly endangering another person. Court records filed at the time he was arrested alleged that on the night of Sept. 24, Bodistow, who was under the influence of several drugs, allegedly cut his girlfriend’s wrist with a circular saw when he was fighting off imaginary intruders.
Daniel R. Vargas, 28, of Bradford, will serve 90 days to 18 months in state prison for charges of flight to avoid apprehension and possession of drug paraphernalia. On Nov. 14, Vargas pleaded guilty to allegations that on Sept. 21, he concealed himself inside 23 Pearl St., Bradford, and he was in possession of drug paraphernalia.
Tyler J. Wilt, 23, of Bradford, will serve 15 months to seven years in state prison with credit for 133 days of time served for DUI-alcohol and controlled substance.
David Rivera, 30, of Bradford, will serve 30 days to one year in McKean County Jail with credit for 105 days of time served and one year of consecutive probation for a charge of simple assault and summary charges. On Nov. 14, Rivera pleaded no contest to allegations that on Aug. 29, he used a door to slam his mother’s arm, and he was part of an argument that was so loud the neighbors could hear. His mother made a statement Thursday in court saying that he did not slam her arm on purpose — her arm was in the way when he was slamming the door — but she noted that he does need alcohol counseling.
Julio Massas, 41, of Hazelton, will serve 20 days to 18 months in McKean County Jail for a charge of theft by deception. He must also pay $12,918.15 in restitution to Seneca Distributions. Massas pleaded guilty Oct. 31 to allegations that between Jan. 2, 2017, and Dec. 29, 2017, he obtained property using a credit card belonging to Seneca Distribution, and he created receipts for a false business.
Alex C. Green, 20, of Bradford, will serve 20 days of day reporting and 14 days to 18 months in McKean County Jail with credit for two days of time served for charges of criminal trespass, defiant trespass and summary charges. Green was found guilty of the charges in a jury trial in October. Court records filed at the time of Green’s arrest alleged that at 4:31 a.m. Jan. 1, he smashed out front windows of a West Corydon Street home while he was under the influence of alcohol and tried to enter while the home’s occupants, who did not know Green, were trying to keep him from coming through the window. Public Defender Philip Clabaugh on Thursday that he believed that he was at a different house.
David P. Peterson, 50, of Kane, will serve five years in the Intermediate Punishment Program for charges of DUI-alcohol and summary charges.
Curtis G. Snyder, 46, of Camp Hill, will serve six months to two years in state prison for a charge of retail theft.
Michael L. Haynes, 57, of Mount Jewett, will serve six to 12 months in McKean County Jail for charges of DUI-controlled substance, habitual offenders and a summary charge.
Daniel R. Gleason, 31, of Portville, N.Y., will serve seven days to six months in McKean County Jail for a charge of DUI-general impairment.
Shane P. Stevens, 43, of Kane, will serve three days to six months in McKean County Jail for a charge of DUI-combination of alcohol/drugs and a summary charge.
David A. Wolfe, 24, of Kane, will serve 15 days to six months in McKean County Jail with credit for 61 days of time served for charges of DUI-controlled substance. This was a resentence, as he was granted acquittal on a fourth charge after he was sentenced the first time.
Michael M. Maddox, 24, of Bradford, will serve 18 months of probation for charges of possession of a controlled substance, possession of drug paraphernalia.
Donald L. Honhart Jr., 50, of Bradford, will serve one year of probation for charges of distribute small amount of marijuana/not for sale, possession of drug paraphernalia and summary charges. Honhart pleaded guilty Nov. 14 to allegations that on Aug. 30, he distributed a small amount of marijuana that was not for sale.
Alyson L. Black, 45, of Rew, will serve six months in the Intermediate Punishment Program for a charge of DUI-general impairment and a summary charge.
Cory L. Quintero, 21, of Eldred, will serve six months of probation for a charge of DUI-general impairment and summary charges.
