SMETHPORT — A Bradford woman accused of using someone’s ATM card and selling a substance she purported was cocaine entered a guilty plea Thursday in McKean County Court.
Tuesday L. Hale, 53, pleaded guilty to a charge of access device fraud in one case and in a second case to a charge of selling a non-controlled substance represented as a controlled substance.
According to District Attorney Stephanie Vettenburg-Shaffer, between Feb. 15 and March 20 in 2018, Hale used a man’s ATM card to receive $260; Also, on March 5, 2019, while under the surveillance of the McKean County Drug Task Force, Hale sold a non-controlled substance, saying it was cocaine.
Sentencing for Hale will be scheduled for a later date before Elk County Senior Judge Richard Masson. Court records indicate a codefendant in the fraud case — Hale’s son, Tate W. Hallock, 25, of Bradford — pleaded guilty Aug. 28 to a charge of conspiracy-access device fraud. Hallock is scheduled to be sentenced Nov. 12.
Also in court, Frank J. Szarowicz Jr., 45, of Kane, pleaded guilty to charges of simple assault and recklessly endangering another person. On Aug. 1 in Kane, Szarowicz punched another adult male in the right side of his face, causing the man to fall on the pavement and hit his head, Shaffer explained. The victim was knocked unconscious and was transported via medical helicopter for treatment, and he could not move and believed he was paralyzed for several days. The victim has generally recovered from the injuries, Shaffer noted. Szarowicz will be sentenced Nov. 21.
Sarah M. Bauer, 33, of Bradford, pleaded guilty to a charge of recklessly endangering another person. Between Dec. 7, 2016, and April 23, 2018, Bauer struck a child too hard while disciplining him and missed several doctor appointments for the child despite the fact that the child was underweight and repeatedly banging his head, said Shaffer. Bauer will be sentenced Nov. 21.
Joshua C. Pingie, 27, of Bradford, pleaded guilty to charges of criminal trespassing, theft by unlawful taking and criminal mischief. Assistant District Attorney Ashley Shade said that on Oct. 11, 2018, Pingie entered 56 Heather Lane, Corydon Township, took alcoholic beverages and a candle worth a total of $112, and damaged two doors, a window screen and bedding. He will be sentenced Nov. 7.
Josef D. Godfrey, 29, of Bradford, pleaded guilty to a charge of burglary. Assistant District Attorney Bridget Murphy said that on July 1, Godfrey entered a home at 43 Euclid Ave., Bradford — coming through three basement doors, damaging some of them — and drank beer. He will be sentenced Nov. 7.
Chad C. Reed, 28, of Smethport, pleaded guilty to charges in two cases: a charge of resisting arrest in one case, and in the other, charges of DUI-controlled substance, possession of a small amount of marijuana for personal use, possession of drug paraphernalia and a summary charge. Charges in a third case were dismissed as part of the plea agreement. According to Assistant District Attorney Ashley Shade, on Jan. 25, Reed fought and resisted two Bradford City police officers who were trying to take him into custody; physical force was required to overcome Reed. Then, on June 24, Reed drove under the influence of marijuana, amphetamines, MDMA and clonazepam. Reed will be sentenced Oct. 24.
Michael S. Lockerbie, 54, of Jamestown, N.Y., pleaded guilty to a charge of retail theft. On Jan. 22, Lockerbie took a 55-inch Samsung television from Walmart valued at $548, said Murphy. He will serve two days to one year in McKean County Jail with credit for two days of time served.
Daniel L. Jones, 27, of Smethport, pleaded guilty to a charge of receiving stolen property. On Oct. 24, 2018, Jones received three stolen trail cameras worth about $500, said Murphy. He will be sentenced Nov. 21.
Ralph D. Abbott, 72, of Port Allegany, pleaded guilty to a summary charge of harassment. He will be sentenced Nov. 7.
James P. Przybyszewski, 33, of Duke Center, pleaded guilty to a summary charge of harassment. He will pay a $200 fine.
Timothy M. Slater, 36, of Kane, pleaded guilty to charges of possession of drug paraphernalia and summary charges. He will be sentenced Nov. 21.
Eric V. Fishkin, 27, of Bradford, pleaded guilty to a charge of possession of drug paraphernalia. He will be sentenced Nov. 7.
The following people were accepted into the Accelerated Rehabilitative Disposition program: Melissa J. O’Neil, 37, of Bradford, for DUI-alcohol and controlled substance; Gerald L. Bizzak, 70, of Kane, and Taylor R. Roggenbaum, 23, of Bradford, both for DUI-alcohol; Anthony R. Bevacqua, 32, of Bradford, for DUI-controlled substance; Dakota C. M. Gros, 22, of Avonmore, for institutional vandalism and possession of drug paraphernalia and a small amount of marijuana; Tonie M. Westlake, 31, of Bradford, for possession of a small amount of marijuana and possession of drug paraphernalia; Jacklyn M. Pusateri, 57, of Kane, and Jay B. Ervin, 26, of Bradford, both for DUI-general impairment.
