A Bradford man was arrested Saturday night at Festa Italiana after an alleged “scuffle” with Bradford City Police.
Brent M. McGuire, 43, of 123 Seaward Ave., was arraigned before District Judge Dominic Cercone on charges of resisting arrest, a second-degree misdemeanor; disorderly conduct, a third-degree misdemeanor; and public drunkenness, a summary charge.
According to the criminal complaint, at 11:15 p.m. Saturday in the Tops Friendly Markets parking lot, festival security notified Bradford City police officers of a male who was following a female and pulling on her. The officers were on foot patrol duty at the event.
Police went to talk to the male — McGuire — who seemed “very intoxicated” and told officers the female was his girlfriend, court records indicated.
However, when officers reached McGuire, “the female kept walking away to get away from McGuire who was following her,” the complaint stated.
Court records said McGuire “became aggressive and started to pull away from officers”; a “scuffle ensued” when police tried to take McGuire into custody, and an officer used a Taser on him before they were able to get him into custody.
McGuire was initially incarcerated in McKean County Jail in lieu of $10,000 bail, but court records indicate bail has since been decreased to 10 percent of $5,000 bail at the request of his parents, and he was released. McGuire is scheduled to appear in Central Court on Aug. 22.
Bradford man jailed on theft allegations
A Bradford man is in McKean County Jail after he allegedly stole a cell phone during a domestic dispute on Sunday.
David D. Mihalko, 39, of 177 South Ave., was arraigned Sunday before District Judge Dominic Cercone on charges of theft of property lost, etc., by mistake and receiving stolen property, third-degree misdemeanors; and harassment, a summary charge.
The criminal complaint states that at 12:22 p.m. Sunday, Bradford City Police were called to a domestic dispute at Mihalko’s residence. When officers arrived, a woman there told them Mihalko had fled on foot in the woods near Maplewood Avenue.
Police tried to find Mihalko but could not at that time.
When police interviewed the woman, she said Mihalko “was up all night and had been using drugs,” records stated. Then, he allegedly secured a door in the home so she was not able to leave until someone kicked the door in.
The woman tried to leave the scene in a motor vehicle, but Mihalko allegedly entered the vehicle and prevented her from leaving. When she threatened to call police, he stole a cell phone that belonged to a neighbor that was in the vehicle, then left on foot, according to the complaint.
The woman went to the YWCA to try to learn about obtaining a protection from abuse order; while she was there, Mihalko called her cell phone multiple times using the phone he stole from the vehicle and began arguing with her. Police used the woman’s phone to call Mihalko and tell him to return to his home address. Mihalko failed to return, and police took him into custody near the intersection of Congress and Elm streets.
The complaint also mentions a separate incident in which a bystander reported that on Saturday the bystander witnessed Mihalko strike an 11-year-old child in the face.
Additionally, a state parole officer plans to issue a detainer against Mihalko, the complaint indicated.
Mihalko was sentenced in 2017 to 21 to 42 months in state prison for criminal charges in four separate cases including two simple assault cases, one theft case and one DUI/eluding an officer case.
In the new case, Mihalko is scheduled to appear in Central Court on Aug. 22.
