SMETHPORT — A Kane man was sentenced Thursday in McKean County Court for allegations he took more than $20,000 from a Kane business.
Timothy R. Zampogna, 52, of Kane, will serve 45 days to 23 ½ months in McKean County Jail with credit for 28 days of time served and pay $21,048 in restitution for charges of theft by unlawful taking and bad checks.
Zampogna pleaded guilty May 2 to allegations that he cashed checks belonging to Flickerwood Winery for $21,048 at Save-A-Lot; also, he wrote a check to Save-A-Lot from his own checking account for $625 knowing it would not be honored. His family owns Flickerwood.
District Attorney Stephanie Vettenburg-Shaffer read from a letter from Zampogna’s siblings.
Zampogna’s “crimes were detrimental to our business and our family,” they wrote, explaining that his drug addiction caused his behavior. “This is not about the money. We are heartbroken. This is our brother.”
They added they were “humiliated” by how the missing money affected them. “We’ve had to beg companies to work with us on outstanding bills and had to go without being paid.”
Still, their big fear was the possibility they would get a phone call that their brother lost his battle with drug addiction.
Prior to receiving his sentence, Zampogna said, “I just want my family to know how sorry I am. I realize how bad this had affected my whole family,” he said, adding that he wants to make it up to them.
Also in court, Rhonda L. Hanes, 20, of Duke Center, will serve seven to 18 months in McKean County Jail and three years of concurrent probation for a charge of statutory sexual assault: 4-8 years older. Hanes pleaded guilty May 16 to allegations that between Dec. 12-31, she had sexual intercourse with a 14-year-old boy.
Hanes is pregnant with the victim’s child, Shaffer noted on Thursday.
John T. Winn, 33, of Bainbridge, N.Y., will serve five to 23 ½ months in McKean County Jail with credit for 148 days of time served and two years of concurrent probation and pay $1,396.01 in restitution for charges of resisting arrest, criminal mischief and simple assault. On May 16, Winn pleaded guilty to allegations that on Jan. 9 at Bradford Regional Medical Center, he tried to prevent four Bradford City police officers from taking him into custody, caused more than $1,000 in damage to the side of his mother’s vehicle and injured Officer Terry Fuqua.
Laura Dennison-Haight, 50, of Bradford, will serve 30 days to 18 months in McKean County Jail with credit for 35 days of time served for a charge of conspiracy to deliver a controlled substance. Court records filed at the time Haight was arrested alleged that on Oct. 20, 2017, she allowed Dwayne Higgs into her home so he could sell crack cocaine from there.
Jack A. Niklas, 24, of Kane, will serve 10 days to 18 months in McKean County Jail for a charge of simple assault. Niklas pleaded guilty April 25 to allegations that on June 19, he head-butted a male in the nose.
Ginger S. Post, 50, of Port Allegany, will serve 18 months of probation for a charge of hindering apprehension/prosecution-harbor or conceal. On May 16, Post pleaded guilty to allegations that on March 12, she harbored in her Port Allegany home a man who was wanted by law enforcement officials in Tioga.
Bryan K. Hathaway, 25, of Portville, N.Y., will serve 30 days to six months in McKean County Jail and six months of consecutive probation for charges of DUI-general impairment and summary charges in two separate cases.
Robert E. Howard Sr., 63, of Limestone, N.Y., will serve five days to six months in McKean County Jail for charges of DUI-controlled substance and alcohol and summary charges.
Robert G. Mosher, 29, of Bradford, will serve five days to six months in McKean County Jail for charges of DUI-controlled substance and alcohol.
Louis J. Colts Jr., 37, of Bradford, will serve six months in the Intermediate Punishment Program for a charge of DUI-general impairment and a summary charge.
Carol F. Bunce, 62, of Bradford, will serve six months in the Intermediate Punishment Program for charges of DUI-alcohol and a summary charge.
