A Port Allegany man waived a preliminary hearing Monday for aggravated assault and stalking cases, court records indicate.
Christopher R. Ballway, 29, of Port Allegany, remains incarcerated in McKean County Jail without bail. District Judge William Todd ordered the bail denial at the time he was arraigned on the second case because Ballway “committed further crime against the alleged victim and violated his bail conditions,” the online court docket states.
Ballway is charged in the first case with aggravated assault, a first-degree felony; strangulation, a second-degree felony; simple assault and recklessly endangering another person, second-degree misdemeanors; and summary harassment. He’s charged in the second with stalking, a first-degree misdemeanor; defiant trespassing and loitering and prowling at night time, third-degree misdemeanors; and summary charges of harassment and criminal trespassing.
According to one of the criminal complaints, state police were called to a Port Allegany residence late Dec. 21 or early the morning of Dec. 22, and arrived at 12:13 a.m. The female victim at the residence told police that Ballway had knocked on her door, and when she opened it, he pushed it all the way open and grabbed her neck with both hands, choking her. He then “tried to make (the victim) kiss him,” the records alleged.
She tried to tell him to stop, and when he did, he pushed her aside and left the residence, the records stated.
Then, early in the morning of April 22, police were called to a Port Allegany home, where the woman there told police she arrived home to find Ballway on her porch attempting to unscrew the lightbulb from her porch light, one of the complaints stated. When he saw the woman’s vehicle pull into the driveway, he fled the area.
He left several items on her porch as well, the complaint read.
Crosby woman arraigned on theft charge
A Crosby woman was arraigned Monday on a felony theft charge for allegations she stole money from the business where she worked.
Jennifer G. Carpenter, 34, of 9407 Route 46, Crosby, was arraigned before District Judge William Todd on one charge of theft by unlawful taking, a third-degree felony.
According to the criminal complaint, on May 22, Lewis Run-based state police talked to Melinda Milford from Herzog’s Valley Store. She explained that on May 21, she was going over the sales from the day before and noticed numbers related to gasoline sales were off. With further investigation, she realized there were several refunds made.
Milford looked at the store video and realized that Carpenter was taking money out of the register by using the refund button, then using the money to purchase lottery tickets. During a time period of about a week, Carpenter took $2,110, the complaint stated.
Carpenter is free on $10,000 unsecured bail. She is scheduled to appear in Central Court on June 20.
Threat charge against Crosby man withdrawn
A misdemeanor charge of terroristic threats against a Crosby man has been withdrawn, according to court records.
David L. Rounsville Sr., 65, was scheduled to appear for a preliminary hearing Monday before District Judge William Todd. The misdemeanor charge was withdrawn, but Rounsville pleaded guilty to a summary harassment charge, court records indicate.
The case is now closed.
