SMETHPORT — A Buffalo, N.Y., man entered a guilty plea Thursday in McKean County Court to drug delivery charges.
Mitchell R. Garner, 29, pleaded guilty to charges of conspiracy to deliver a controlled substance, possession with the intent to deliver a controlled substance and possession of a controlled substance contraband by an inmate. District Attorney Stephanie Vettenburg-Shaffer said that on Dec. 18, Garner conspired with Leonard Elder to deliver 0.8 grams of cocaine while under the surveillance of the McKean County Drug Task Force; then, while an inmate, he possessed 4.9 grams of crack cocaine with the intent to deliver it.
He will be sentenced May 9.
Also in court, Timothy R. Zampogna, 51, of Kane, pleaded guilty to charges of theft by unlawful taking and bad checks. Shaffer said that Zampogna cashed checks belonging to Flickerwood Winery for $21,048 at Save-A-Lot; also, he wrote a check to Save-A-Lot from his own checking account for $625 knowing it would not be honored. He will be sentenced June 6.
Zachary M. Koch, 20, of Bradford, pleaded guilty to charges of criminal trespassing and three summary charges. On Nov. 13, Koch entered a garage at 13 E. Songbird Road, Shaffer said. Koch will be sentenced May 9.
Amy G. Spruce, 42, of Salamanca, N.Y., pleaded guilty to charges of simple assault, disorderly conduct and a summary charge. On Jan. 24, Spruce injured someone working at Bradford Regional Medical Center, causing redness and scratching, caused $150 in damage to a hospital wall and acted in a disorderly fashion there, Shaffer explained. Spruce will be sentenced June 6.
Jonathan D. Card, 26, of Bradford, will serve 60 days to 23 ½ months in McKean County Jail with credit for 87 days of time served for a charge of simple assault. Card pleaded guilty April 25 to allegations that on Dec. 27, he punched his girlfriend twice in the head during an argument.
Jade M. Horn, 36, of East Smethport, pleaded guilty to a charge of furnishing liquor to a minor. Assistant District Attorney Jerry Grill said that between May 1 and Nov. 18 in 2018, Horn furnished liquor to a juvenile female who was 14 then 15 years old during that time. Horn will be sentenced May 23.
Myra L. Meacham, 48, of Bradford, pleaded guilty to a charge of unsworn falsification to authorities. On Sept. 17 Meacham made a false statement on a firearm transaction record, said Grill. She will be sentenced May 23.
Kenneth M. Nierenberger, 30, of Smethport, pleaded guilty to a charge of institutional vandalism. According to Shaffer, on Oct. 17, Nierenberger caused $421.40 in damage to a McKean County Jail cell window. He will be sentenced May 23.
Nicholas C. Zetwick, 34, of Enola, will serve 72 hours to six months in McKean County Jail for charges in a DUI case.
Robin L. Victory, 55, of Bradford, pleaded guilty to a charge of retail theft. On Nov. 26, Victory took $55.57 worth of merchandise from Walmart, said Assistant District Attorney Bridget Murphy. She will be sentenced May 23.
The following people were accepted into the Accelerated Rehabilitative Disposition program: Michael J. Cornelius, 45, of Bradford, for DUI-alcohol and controlled substance; and Patrick J. Conneelly, 53, of Bradford, and Derek A. Roberts, 31, of Kane, both for DUI-alcohol.
