A Salamanca, N.Y., man who is accused of driving into the former Fox’s Pizza Den building in Eldred after smoking marijuana and drinking alcohol was arraigned Tuesday.
An arraignment for Nicholas J. Sands, 30, of 23 Herman St., Salamanca, was held Tuesday before District Judge William Todd on charges of DUI-general impairment, possession of marijuana and possession of drug paraphernalia; and the following summary charges: restrictions on alcoholic beverages, careless driving, duties at a stop sign and driving at a safe speed.
According to the criminal complaint, at 11:11 p.m. Aug. 17, an officer with the Otto-Eldred Regional Police was sitting in a patrol vehicle in the parking lot of the Dandy Mini Mart in Eldred Borough, facing the intersection of Prentisvale Road (Route 346) and Main Street (Route 446). The Dandy Mini Mart is next door to the former Fox’s restaurant.
The officer watched a car traveling on Route 346, continue through the intersection and hit Fox’s. As the officer approached the crash scene, he watched Sands walk out of the restaurant, court records stated.
According to court records, the officer asked Sands if he remembered anything; Sands did not. He asked if Sands if he knew where he was; Sands said he was down the road from his Salamanca home. He asked if Sands knew he was he was in Eldred; Sands replied, “Where the f- — is that?”
When the officer asked Sands if had any alcohol, drugs or medication that night, Sands told him he drank Fireball whisky and smoked marijuana, the complaint stated.
On Aug. 23, police obtained a warrant to search Sands’s car and found a small amount of marijuana, drug paraphernalia and several open alcohol containers including several Fireball bottles, according to the complaint.
A Central Court date for Sands is set for April 25.
