SMETHPORT — A Rixford woman, who was accused of conspiring with then-husband William Tipton to allow him to possess a firearm illegally, was sentenced Thursday in McKean County Court to a term in state prison.
Julie A. Tipton, 37, will serve 22 to 44 months in state prison with credit for one day of time served for a charge of conspiracy-possession of a firearm prohibited. She was found guilty at a jury trial on Feb. 12.
Her then-husband, William Tipton, pleaded guilty in May to charges of possession of a firearm prohibited and endangering the welfare of a child, and he is serving five to 10 years in state prison for the conviction. He allowed a child to shoot the handgun outside his home while police were there.
Tipton’s attorney, Christopher Martini, made an oral motion for extraordinary relief, seeking relief such as a new trial. President Judge John Pavlock denied the request.
Prior to sentencing, Pavlock was given a letter from Julie Tipton, which he read silently. When he finished, he summed it up by saying the letter “blames everyone else for everything.” After describing further the discrepancies between the trial testimony and her letter, Pavlock said, “The defendant is still not taking responsibility for this.”
Also in court, Andrew J. Beck, 28, of Smethport, will serve one to four years in state prison with credit for 138 days of time served for charges in two cases. He’s charged in one case with terroristic threats, simple assault and recklessly endangering another person and in the second with possession of a controlled substance and possession of drug paraphernalia. Court records filed at the time Beck was first charged in the assault case indicate he was accused of assaulting a woman over a two-day period, threatening to kill her and nearly striking two people with his car.
