Charges against a Shinglehouse man accused of assaulting a police officer were bound to McKean County Court on Monday.
Devin R. Jenkins, 30, appeared for a preliminary hearing Monday before District Judge William Todd.
Jenkins is charged with aggravated assault, a felony; resisting arrest, a second-degree misdemeanor; DUI-general impairment, a misdemeanor; and the following summary charges: criminal trespassing, disorderly conduct, careless driving, trespassing by motor vehicle and harassment.
According to the criminal complaint, at 3:30 a.m. Jan. 5, Officer Kyle Day was dispatched for a complaint regarding a vehicle that was across from the car wash on Herzog property.
Day arrived to find Jenkins allegedly passed out at the steering wheel of a Chevrolet Silverado pick-up truck that was stuck with the rear tires spinning. Jenkins was slumped over the wheel with his foot on the gas and a bottle of Black Velvet whiskey on the seat next to him, the complaint indicated.
Jenkins didn’t wake up until Day turned off the truck; then, Jenkins was instantly combative, exiting through the passenger door and punching Day several times, according to court records.
Day deployed his Taser twice, then tried to dry-stun Jenkins, which was not effective. Next, Day sprayed pepper spray in Jenkins’ face; the pair continued to struggle until another officer arrived to help detain Jenkins, records indicated.
Jenkins, who smelled like alcohol and had glassy, bloodshot eyes, told police he believed he was in Kane, the complaint stated. Police transported Jenkins to the Smethport Borough police station; when officers were taking him inside, he allegedly became combative again and kicked Chief Patrick Warnick, who decided Jenkins should be taken to McKean County Jail for everyone’s safety.
Jenkins is now free, having posted $30,000 bail.
