Charges against a man accused of stealing more than $4,000 from his employer were bound to McKean County Court on Monday at a preliminary hearing before District Judge William Todd.
Dustin T. Jacoby, 33, of 358 Champlin Hill Road, Smethport, is charged with burglary, a second-degree felony; theft by unlawful taking, receiving stolen property and criminal trespassing, all third-degree felonies; and receiving stolen property, a first-degree misdemeanor.
According to the criminal complaint, at 11:38 p.m. Feb. 1, Smethport Borough Police were dispatched to the Corner Bistro and Pizza Co. for allegations that an employee — Jacoby — was caught on video stealing money from the business.
When the officer arrived, another employee pointed out Jacoby, who was standing outside; however, when the officer approached him, he went inside the Corner Bar. Instead, the officer went to watch the video of the alleged theft, which showed Jacoby taking something from an area where money from the business is kept, court records stated.
An employee told the officer that on Jan. 31 and Feb. 1, she marked bills and took pictures of the serial numbers because they believed someone was stealing.
The officer told Jacoby about the allegations and asked to see his wallet. Jacoby said he did not have a wallet, so the officer asked if he would empty his pockets. When he did, he pulled out a “large amount of money” that included 20- 50- and 100-dollar bills; most of the $870 in bills were marked with a pen and matched the serial numbers from the photographs, according to the criminal complaint.
Court records indicate that Jacoby took more than $4,000 overall from the business, though an exact amount was not listed.
Jacoby is free, having posted $5,000 bail.
