A case against a Bainbridge, N.Y., man accused of assaulting an officer has been bound to McKean County Court.
John T. Winn, 32, appeared for a preliminary hearing Wednesday before District Judge Dominic Cercone on charges of aggravated assault, a second-degree felony; terroristic threats, a first-degree misdemeanor; resisting arrest and criminal mischief, second-degree misdemeanors; disorderly conduct, a third-degree misdemeanor; and summary charges of harassment and criminal mischief.
According to the criminal complaint, while a woman was driving her son — Winn — for rehab treatment at Bradford Regional Medical Center, he threatened to knock her out and kill her; when she called 911, he threw her phone out the window.
Bradford City Police informed Winn he was being arrested for threats and disorderly conduct; two officers grabbed his arms, and he tensed his arms and clenched “his fists and began violently resisting arrest,” the complaint stated.
Officers tried taking Winn to the ground, but he allegedly kept fighting. At one point, he thrust backward into Patrolman Terry Fuqua; Fuqua was knocked backward to the ground, in the process striking his head, neck, back and left elbow and hitting a vehicle door so hard it was dented in, according to court records.
Three other officers tried to use physical force to get Winn down, but it wasn’t until Fuqua was able to get up and subdue Winn with a Taser that officers were able to handcuff him, the complaint indicated. While Winn was being taken to the police car, he allegedly kicked backward, striking Patrolman Richard Obermeyer.
Winn is in McKean County Jail in lieu of $75,000 bail.
