A Bainbridge, N.Y., man is in McKean County Jail on allegations of violently resisting arrest and injuring a Bradford City Police officer on Wednesday morning.
John T. Winn, 32, of 464 County Road 38, is charged with aggravated assault, a second-degree felony; terroristic threats, a first-degree misdemeanor; resisting arrest, a second-degree misdemeanor; disorderly conduct, a third-degree misdemeanor; and harassment and criminal mischief, summary offenses.
According to court records, the incident began when Winn’s mother was driving him to Bradford Regional Medical Center to get him into rehab. She called the McKean County 9-1-1 Center at 11:18 a.m. and told dispatchers she needed help because her son jumped out of her car on Forman Street. The phone hung up and dispatchers could not get her to answer again, the criminal complaint read.
Officers began searching for them when dispatchers reported the woman and her son were at BRMC. Police responded and were speaking to his mother, who said her son began acting out against her in her car, making a fist and threatening to kill her. She told police that Winn is a drug addict and is highly aggressive. She explained that when she called 9-1-1, he took her phone and threw it out the car window, the complaint read.
While officers were speaking to Winn, he continued getting agitated and walked out of the hospital to his mother’s car. Officers followed, asking him to stop trying to get in the car and to calm down. Assistant Chief Mike Ward told Winn that he was under arrest and grabbed his arm as Patrolman Terry Fuqua grabbed his other arm. Winn began “violently resisting arrest,” and Ward, Fuqua and Patrolman Richard Obermeyer attempted to take him to the ground to place him in cuffs, the complaint stated.
Winn “thrusted backward” into Fuqua, knocking him to the ground. Fuqua’s head, neck, back and elbow struck a vehicle hard enough to dent it, the complaint alleged.
Sgt. Todd Erickson arrived and began assisting Ward and Obermeyer to try to get Winn under control. Fuqua tased Winn, allowing the officers to safely subdue him. As officers were taking Winn to the patrol car, he kicked Obermeyer, but didn’t cause injury, the complaint stated.
Fuqua required medical attention for his injuries.
Winn was arraigned by on-call District Judge David Engman and jailed in lieu of $75,000 bail. He is scheduled to appear in Central Court Jan. 17.
