A Shinglehouse man who got his truck stuck in Smethport — while thinking he was in Kane — has been accused of DUI and assaulting a Smethport Borough Police officer.
Devin R. Jenkins, 29, of 2585 Kings Run Road, Shinglehouse, was arraigned Saturday before District Judge William Todd on charges of aggravated assault, a first-degree felony; resisting arrest, a second-degree misdemeanor; DUI-general impairment, a misdemeanor; and the following summary charges: trespassing by motor vehicle, criminal trespassing, disorderly conduct and careless driving.
According to the criminal complaint, at 3:30 a.m. Saturday, Officer Kyle Day was dispatched for a complaint regarding a vehicle that was across from the car wash on Herzog property.
Day arrived to find Jenkins allegedly passed out at the steering wheel of a Chevrolet Silverado pick-up truck that was stuck with the rear tires spinning.
The officer opened the passenger truck door and saw Jenkins slumped over the wheel with his foot on the gas, the complaint stated. A bottle of Black Velvet whiskey lay on the seat next to Jenkins right leg.
Day identified himself as an officer and tried to wake Jenkins up several times without success. When Day turned off the truck, Jenkins woke up and was instantly combative, exiting through the passenger door and punching Day several times, bending Day’s eyeglasses, according to court records.
Day deployed his Taser twice, then tried to dry-stun Jenkins, which was not effective. Next, Day sprayed pepper spray in Jenkins face; the pair continued to struggle until another officer arrived to help detain Jenkins, records indicated.
Jenkins, who smelled like alcohol and had glassy, bloodshot eyes, told police he believed he was in Kane, the complaint stated. Police transported Jenkins to the Smethport Borough police station; when officers were taking him inside, he allegedly became combative again and kicked Chief Patrick Warnick, who decided Jenkins should be taken to McKean County Jail for everyone’s safety.
Jenkins is incarcerated in lieu of $30,000 bail, and he is scheduled to appear in Central Court on Thursday.
