A Bradford man’s alleged overdose has led to criminal charges against him and a woman who was present while he smoked marijuana in front of a three-year-old child.
On Thursday, Amila Rose Sprague, 32, and Walter Jay Gutshall, 36, both of 102 Congress St. Apt. 5, were each arraigned on one count of endangering the welfare of a child, a third-degree felony.
According to the criminal complaint, at 9:49 p.m. Nov. 28, police were dispatched to the couple’s residence for a report of an intentional overdose. Gutshall had “taken 20 Mucinex tablets, drank half a bottle of whisky and smoked marijuana earlier in the day.”
He was transported to Bradford Regional Medical Center for treatment. Sprague spoke to police, saying she had left a three-year-old child with Gutshall while she left the apartment earlier in the day. When she came back two hours later, the apartment door was open, Gutshall was sleeping and the child was missing, the complaint stated.
The child was found in the downstairs foyer with a neighbor. She told police that when she left, Gutshall was awake and alert and knew he had to watch the child.
After that, she had made plans to go stay with her sister, she told police. She offered to show text messages to the officer showing she had been planning to leave the apartment. The officer “observed a message (which) stated that Gutshall passed out while watching (the child) because he was high,” the complaint alleged.
The officer asked Sprague how she knew Gutshall was high. She said he had smoked marijuana in front of her and the child before she left the apartment, the complaint stated.
Both Sprague and Gutshall were arraigned before District Judge Dom Cercone and released on $1,000 unsecured bail. Both are scheduled to appear in Central Court Jan. 10.
