SMETHPORT — A man accused of assaulting a woman in 2017 was sentenced Thursday in McKean County Court to a term in state prison.
Kruze J. Carpenter-Stewart, 25, will serve six months to two years in prison with credit for 228 days of time served for a charge of simple assault.
Testimony presented at a preliminary hearing in July 2017 indicated that on June 11, 2017, Stewart got into an argument with his then-girlfriend and assaulted her.
According to District Attorney Stephanie Vettenburg-Shaffer, while Stewart was out on bail in the assault case, he was accused in another case — an alleged sex assault — then he went to South Carolina and had to be extradited back to Pennsylvania to face both cases.
On Thursday, President Judge John Pavlock initially ordered a jail sentence, but he changed it to a prison sentence after Stewart tested positive for buprenorphine and marijuana.
The sex assault case against Stewart is still pending.
Also in court, Ronald L. Kennedy, 40, of Bradford, will serve five years in the Intermediate Punishment Program for charges of DUI-alcohol and summary charges.
Christopher C. Bundy, 28, of Kane, will serve 18 months of probation for a charge of simple assault. On Dec. 6, Bundy pleaded guilty to allegations that he assaulted a woman.
Kelsey K. Ackley, 19, of Kane, will serve one year of probation and pay $2,305.47 in restitution for a charge of access device fraud. She pleaded guilty Oct. 18 to allegations that between Jan. 1-31, Ackley possessed someone else’s credit card without permission.
Mark T. Foltz, 35, of Port Allegany, will serve 10 days to six months in McKean County Jail for charges of DUI-general impairment and summary charges.
Donavon J.L. Austin, 26, of Belmont, N.Y., will serve three days to six months in McKean County Jail for charges of DUI-alcohol and DUI-controlled substance and a summary charge.
