SMETHPORT — A Rixford man was sentenced Thursday in McKean County Court for allegations that he was involved in a police chase in April in Bradford.
Gary A. Simes Jr., 36, will serve 11 ½ to 23 ½ months in McKean County Jail with 216 days of credit for time served and two years of concurrent probation for charges of fleeing or attempting to elude an officer, DUI-general impairment, resisting arrest and summary charges.
Court documents filed at the time of his arrest indicated that at 1:13 a.m. April 28, a Bradford City police officer tried to pull Simes over after watching him make a left-hand turn during a red light from Davis Street to Main Street. He did not pull over, and police began to pursue him.
At one point in the pursuit on South Kendall Avenue, Simes alleged turned and drove straight at a police car, the original complaint stated.
The chase ended on Looker Mountain Trail when the van he was driving went out of control, traveled off the road, became airborne and came to rest about 75 yards from the road, according to the complaint.
Also in court, Larry D. Kline, 42, of Port Allegany, was sentenced to 40 days to 23 ½ months in McKean County Jail with credit for 65 days of time served for charges in two cases. He’s charged in one with simple assault and in the second with DUI-controlled substance and summary charges. According to the criminal complaint filed in December for the assault case, Kline punched a woman in the face, placed her in a choke hold and said he was going to “knock her teeth down her throat.”
Tammy S. Allen, 46, of Bradford, will serve two to 18 months in McKean County Jail with credit for 75 days of time served for charges of criminal trespassing and theft by unlawful taking. On Nov. 1, Allen pleaded guilty to allegations that on May 16, she, Luke Wolfe and Joseph Frontera entered a Bradford residence and took $650 in items including weed wackers, a mountain bike, oxycodone pills, a checkbook and more.
Frederick W. Cochran Jr., 65, of Port Allegany, will serve five years in the Intermediate Punishment Program for charges of DUI-alcohol and summary charges.
Danyelle L. Cabisca, 26, of Bradford, was sentenced to 18 months of probation for a charge of retail theft and a summary charge. Cabisca was also revoked on six previous cases — all retail thefts — which occurred between 2016-17. She told President Judge John Pavlock that she recently sought mental health treatment when she realized she was not able to change her behavior alone.
Steven A. Devitt, 36, of Bradford, will serve five to 18 months in McKean County Jail with credit for 37 days of time served for a charge of simple assault. Devitt pleaded guilty Oct. 18 to allegations that on March 6, after an argument with a former intimate partner, pushed her into the sink.
Jennifer Pinchock, 51, of Roulette, will serve one year of probation for a charge of theft from a motor vehicle.
On Nov. 1, Pinchock pleaded guilty to allegations that on Aug. 1, she took an air rifle valued at $45 from a motor vehicle.
Jordan Kornacki, 21, of Bradford, will serve one year of probation for a charge of theft from a motor vehicle. Kornacki pleaded guilty Nov. 1 to allegations that on Aug. 3, she took $25 in cash from a vehicle.
Aisha R. Alzubi, 23, of Bradford, will serve one year of probation for a charge of possession of drug paraphernalia and a summary charge.
Richard T. Decarli, 65, of St. Marys, will serve six months in the Intermediate Punishment Program for charges of DUI-alcohol and a summary charge.
Joshua S. Lacki, 36, of Lackawanna, N.Y., will serve 90 days of probation for a charge of theft by unlawful taking.
