SMETHPORT — A Kane man was sentenced Thursday in McKean County Court to serve four to 10 years in state prison for pointing a loaded firearm at another man
Shaine S. Miller, 34, had been found guilty of aggravated assault, a first-degree felony; terroristic threats, a first-degree misdemeanor; recklessly endangering another person and simple assault, second-degree misdemeanors; and disorderly conduct, a third-degree misdemeanor, during a two-day trial in September.
District Attorney Stephanie Vettenburg-Shaffer, who had prosecuted the case, recommended that Miller receive a sentence of four years to eight years, as the incident had involved a deadly weapon and occurred close to the victims’ home.
Standing in front of the judge with Public Defender Philip Clabaugh, Miller said he was sorry for what he had done.
“Not only were (the victims) affected but I was affected, as well,” Miller said. “This last year has completely changed my life — I am sorry and accept responsibility for what I did.”
In response, Pavlock said he had considered the facts of the case and a prior offense in 2014 when Miller had discharged a shotgun from his porch as a warning to a victim walking a dog nearby.
In the more recent incident on Oct. 14, 2017, in the area of Greeves and Walsh streets in Kane, Miller had pointed a gun at a man in the presence of a woman and two children.
When police arrived on the scene, they found two men arguing in front of an apartment building, and a Sig Sauer P250 9mm handgun was lying in the grass along Welsh Street. The gun was loaded with 15 rounds of 9mm Luger full metal jacket rounds, according to court records.
Pavlock said that during the incident, which resulted in the current charges, Miller told the victim he had a permit and stated, “I should have just shot you.”
“You’ve got a real problem that you need to deal with,” Pavlock advised Miller. “You should never touch a firearm again.”
In addition to prison time, Miller was sentenced to have an updated mental health and drug and alcohol evaluation and to have no contact with the victims. He was credited with 20 days of time served.
