An Oswayo man was arraigned over the weekend for allegations he took thousands of dollars to do a home repair that he never completed.
Kenneth B. Kellert, 41, of 277 W. Main St., Oswayo, was arraigned Friday night before District Judge Dominic Cercone on charges of home improvement fraud, theft by deception-false impression, theft by deception-failure to correct a false impression and receiving stolen property, all third-degree felonies.
According to the criminal complaint, around Oct. 20, 2016, Kerry Bacha paid Kellert of Kellert’s Construction a down payment of $11,500 to perform roof work on a Duke Center residence. In 2017, Kellert promised he would have the roof and some porch work done by December 2017. Later, Kellert promised to begin the work in March 2018.
On June 18, 2018, an Otto-Eldred Regional Police officer left a phone message for Kellert, who called back the same day and was told of the issue. Kellert told the officer he had not done the work due to weather and said he did not have the money because he used it elsewhere, the complaint stated.
Kellert told the officer he would call Bacha, which he did that same month. Kellert said to Bacha that he would return the money the next week, but he never did, according to court records.
Kellert is free on $20,000 bail, and he is scheduled to appear in Central Court on Thursday.
