A Florida man is in McKean County Jail after he allegedly assaulted a woman early Sunday morning in Kane.
James L. Ackley, 30, of 712 Tunney St., Lehigh Acres, Fla., was arraigned Sunday before District Judge William Todd on charges of aggravated assault, a first-degree felony; strangulation, a second-degree felony; simple assault and recklessly endangering another person, both second-degree misdemeanors; and harassment, a summary charge.
The criminal complaint states that at 4:30 a.m. Sunday, Kane-based state police were dispatched to a North Fraley Street apartment for what was reported as a possible overdose.
At the apartment, a woman told police she and Ackley had been drinking, then they got into an argument about him leaving her apartment. He allegedly pushed her to the ground, causing her to scrape her knee, and punched her in the nose, court records stated.
Ackley walked out her door, then returned for his wallet; she threw it outside. He allegedly pushed the door open and grabbed her by the throat with his right hand. While she was calling 911, Ackley told her no one would believe her because of her personal history, court records stated.
Ackley is incarcerated in lieu of $25,000 bail, and he is scheduled to appear in Central Court on Thursday.
