SMETHPORT — The McKean County Planning Commission voted unanimously Tuesday to deny a variance request from owners of a proposed subdivision in Hamlin Township because the right-of-way doesn’t comply with the current county subdivision and land ordinance, but at the same time left the door open for future consideration.
Owners Les VanGorder and Todd Weaver want to retain ownership of 73 acres, but subdivide 18.56 acres of the property. However, that lot has a 12-foot right-of-way as reflected by the recorded deed of 1961, and prior to adoption of the current ordinance that requires a 50-foot right-of-way. There is a potential buyer for the parcel, which is located on Kasson Road, according to the planning office.
Commission members denied the request pending efforts of the landowners to negotiate with the adjacent landowner to see if agreement can be reached on a 50-foot right-of-way. If not, the matter must come back to the planning commission for further consideration.
In other business, the county planning office has received nine subdivision plans and a land development plan in Bradford City since the commission’s last meeting in January. Six of the subdivisions contained one lot and are located in Liberty, Norwich, Hamlin and Bradford townships and Bradford City.
Two of the subdivisions, in Foster and Norwich townships, contained two lots.
Four were for only for review.
No violations have been found since the last meeting.
