A Kane woman accused of taking $27,000 in fraudulent loans waived a preliminary hearing Monday before District Judge David Engman.
Hillary E. Payne, 33, faces charges including forgery-unauthorized act in writing and forgery-utters forged writing, both second-degree felonies; and theft by deception and theft by unlawful taking, both third-degree felonies.
According to the criminal complaint, while Payne was married to Jason Payne, she forged his signature on two occasions to get loan advances on an account that was solely in his name at Hamlin Bank in Kane. She was employed by the bank at the time.
The first transaction was on Oct. 30, 2015, for $14,000, and the second was on June 10, 2016, for $13,000, court records indicated. She allegedly had the money deposited in an account for which she was an authorized signer, then she took the money out of the account.
When Payne would ask to see statements, she would generate fake ones to present to him so he would not know about the loans, according to court records.
In November 2017, Jason Payne told Hillary Payne that he planned to get a divorce; he learned of the lines of credit and status of his accounts when he subsequently talked to the bank manager, the criminal complaint stated.
Court records indicate that the bank has since refunded Jason Payne $24,219.51 and will be seeking that amount of restitution from Hillary Payne.
She is free on $2,500 unsecured bail.
