A Smethport man who is a former Coudersport school superintendent pleaded guilty Wednesday to one charge of open lewdness.
Richard F. Toner, 70, of 1010 W. Main St. entered the plea Wednesday before District Judge Richard Luther. The charge is a third-degree misdemeanor.
A misdemeanor charges of indecent assault was withdrawn, court records indicate.
Toner was arrested on Halloween for allegations that he exposed himself to his neighbors. The case was initially filed in the office of District Judge William Todd, but it was moved to Luther’s office.
According to the criminal complaint filed at the time of his arrest, at 11:30 a.m. Oct. 30, Toner stood naked in front of his bay front window, which faced West Main Street — and a neighbor’s house. He allegedly had his genitals displayed and was touching himself.
There were children living in that neighboring house, as well as other children living in the neighborhood, court records stated.
On Wednesday, Toner was sentenced to pay fines and costs.
Toner was the Coudersport Area School District superintendent from 2008-10.
