SMETHPORT — A Smethport man will serve two to 4 ½ months in state prison for crack cocaine delivery.
Ryan J. Buterbaugh, 20, pleaded guilty back on March 9, 2017, to three counts of possession with intent to deliver a controlled substance and dealing in the proceeds of an unlawful act. He already has 120 days of credit for time served.
At that time, District Attorney Stephanie Vettenburg-Shaffer explained that during the time span of April 29 to May 24, while Buterbaugh was under surveillance, he delivered crack cocaine three times, and conspired with a confidential informant of the McKean County Drug Task Force to sell crack cocaine for money.
Buterbaugh also has federal drug delivery charges pending. A federal criminal complaint alleged that between March 31 and Sept. 8, 2016, in Cattaraugus and Erie counties in New York state, Ryan Buterbaugh and his brother, Richard, sold crack cocaine, cocaine and marijuana.
Also in court, James H. Bolyard, 26, of Bradford, will serve six to 18 months in McKean County Jail for a charge of theft by unlawful taking. He will also pay $1,100 in restitution. Bolyard was initially charged in 2016 in two cases for allegations that he accepted money for two home improvement projects that were not done, court records filed at that time indicated. A trial scheduled for Dec. 11 was canceled when he entered a guilty plea to the single charge instead.
Darrell D. Carter, 60, of Bradford, was sentenced to 12 days to 23 ½ months in McKean County Jail with credit for five days of time served for charges of terroristic threats and simple assault. On Jan. 11, Carter pleaded guilty to allegations that on Oct. 1, he threatened his paramour, and he slapped and hit her, hurting her arm and back.
Brett A. Kinney, 33, of Johnsonburg, will serve 96 days to one year in McKean County Jail with credit for 96 days of time served for a charge of simple assault. He pleaded guilty Feb. 8 to allegations that during a mutual fight on Sept. 24, Kinney grabbed a female by her hair, threw her to the ground and hit her.
Robert A. Langfitt, 39, of Eldred, will serve six months in the Intermediate Punishment Program for charges of driving under the influence of alcohol and a summary charge.
