SMETHPORT — A Kane woman accused of making deceptive phone calls to obtain prescription pills pleaded guilty Thursday in McKean County Court.
Elaina M. Scharba, 41, entered the guilty plea to charges of conspiracy to acquire or obtain possession of a controlled substance through misrepresentation and acquisition by fraud.
Scharba allegedly conspired with Kasey Chitester to obtain controlled substances using deception, according to Assistant District Attorney Ashley Shade, who explained that Scharba called pharmacies and pretended to be from a doctor’s office in order to obtain Tylenol 3 and lorazepam.
Scharba will be sentenced March 8.
Chitester has not been convicted of any of the charges filed against her in the case. She was scheduled to appear for a last day to plea conference on Thursday, but the conference was continued to March 15.
Shawn M. Howard, 43, of Smethport, pleaded guilty to charges in two cases. He’s charged in one case with theft by unlawful taking and in the second with criminal trespassing and theft by unlawful taking. Shade said that on July 16, Howard took equipment worth $6,244.12 from a Pithole Road, Cyclone, property; then, on July 23, he stole $40 from someone. He will be sentenced March 8.
Robert E. Stuckey, 51, of Olean, N.Y., pleaded guilty to charges of possession with the intent to deliver a controlled substance, resisting arrest and a summary charge. On Aug. 18, Stuckey possessed about one pound of marijuana with the intent to deliver it, and, when police tried to take him into custody, he resisted arrest, requiring an officer to deploy a Taser, Shade stated. He will be sentenced March 8.
Brett A. Kinney, 33, of Johnsonburg, pleaded guilty to a charge of simple assault. During a mutual fight on Sept. 24, Kinney grabbed a female by her hair, threw her to the ground and hit her, according to Shade. He will be sentenced Feb. 15.
Andrew G. Maholic, 21, of Bradford, was sentenced to 15 days to six months in McKean County Jail with credit for 15 days of time served and one year of probation for charges in two cases. He’s charged in one case with receiving stolen property and a summary charge and in the second case with driving under the influence of a controlled substance, possession of drug paraphernalia, smell/inhale toxic releasing substances and a summary charge.
Jeffrey W. Letson, 54, of Bradford, pleaded guilty to a charge of theft of property lost, mislaid or delivered by mistake. On Oct. 5, Letson took a wallet containing $113, said Assistant District Attorney Jerry Grill. He will be sentenced March 8.
Crystal D. Carr, 36, of Bradford, pleaded guilty to a charge of making a false report. Grill said that on Nov. 20, Carr provided false information to law enforcement officials in order to incriminate another person. She will be sentenced March 8.
Natasha J. Canfield, 26, of Port Allegany, pleaded guilty to a charge of retail theft and a summary charge. According to Grill, on Oct. 18, Canfield entered Walmart after being told not to be there and took a shirt. She will serve one year of probation.
Danyelle L. Cabisca, 25, of Bradford, pleaded guilty to a charge of retail theft. On June 11, Cabisca took $11.51 in merchandise from Country Fair, said Grill. She will be sentenced March 8.
The following people have been accepted into the Accelerated Rehabilitative Disposition Program: Jennifer M. Cannella, 42, of Kane, for possession of a controlled substance and drug paraphernalia; and Chloe R. Harrell, 19, of Bradford, and Joseph N. Fenice, 25, of Bradford, both for possession of drug paraphernalia and a small amount of marijuana.
