A Kane man accused of possessing a stolen trailer and mini excavator in 2016 was arraigned Monday morning on felony receiving stolen property charges.
Court records indicate that Kenneth E. Zook, 42, of 6876 Highland Road, was arraigned before District Judge David Engman on charges of receiving stolen property and conspiracy to receive stolen property, both third-degree felonies.
Zook was released on $25,000 unsecured bail.
A co-defendant, Richard L. Linville, 26, of Reidsville, N.C., who faces the same charges, has yet to be arraigned.
According to court records, at 4 a.m. June 17, 2016, someone took a double-axle trailer and mini excavator from the parking lot of the Home Depot in Rock Hill, S.C. The theft was reported on June 28.
The mini excavator was equipped with a GPS, and Rock Hill police contacted Kane-based state police to recover it, as GPS coordinates indicated it was near 6878 Highland Road in Kane. Troopers found the excavator sitting behind a shed on property owned by Zook, court records indicated.
When police contacted Zook, he said he took the excavator to his house “as it was on a vacant lot near his dealership, Zook motors,” court records stated.
Zook said he did not know who owned it. He explained he borrowed it without telling anyone because he needed to do some work at his house, and one of the reasons he knew the excavator was stolen was because a screwdriver had to be used to started the ignition, the criminal complaint indicated.
According to court records, Zook later told a trooper with the state police auto theft unit that he received the excavator and trailer from Linville, who he had dealt with before in the auto business. Police also reported tracking down video footage of Linville stopping at a gas station in Altoona with the trailer and excavator.
No arraignment date is set for Linville. A full preliminary hearing for Zook is set for 1 p.m. Feb. 12.
