SMETHPORT — A Buffalo, N.Y., man was sentenced Thursday in McKean County Court for charges in two criminal cases.
Dwayne A. Higgs, 37, will serve one to two years in state prison with credit for 90 days of time served and three years of probation, to be served concurrent to — or at the same time as — his prison term. Higgs is charged in one case with possession with the intent to deliver a controlled substance and in the second case with tampering with records.
On Jan. 11, Higgs pleaded guilty to allegations that on Oct. 20, he delivered about one gram of crack cocaine; then, on Oct. 21 at the Bradford City Police Station, he took a lab report from his criminal file when the police officer with him left the room.
Also in court, Karlie A. Ryan, 22, of Oil City, was sentenced to 41 days to 15 months in McKean County Jail with credit for 41 days of time served and pay restitution of $1,778.14 in restitution to charges in two cases. She’s charged in one case with smelling/inhaling toxic substances and in the second case with theft of leased property. On Dec. 14, Ryan pleaded guilty to allegations that between March 9 and July 25, she obtained a mattress set, television and sectional furniture that she leased from the House of Television, and she dealt with the items as if they were her own; then, on Dec. 8, Ryan inhaled fumes from an aerosol air duster.
Byron L. Nichols Jr., 25, of Bradford, pleaded guilty to charges in two cases. He charged in one case with access device fraud and receiving stolen property and in the second case with false identification to a law enforcement officer. Nichols was sentenced to seven days to 16 months in McKean County Jail with credit for eight days of time served, and he will pay $84.17 in restitution. Nichols also waived a hearing for extradition to Maryland, where he faces allegations in multiple incidents.
Thomas A. Gault, 54, of Smethport, will serve 90 days to five years of incarceration for charges of driving under the influence of alcohol and a summary charge.
Kyle T. Payne, 24, of Bradford, will serve two years of probation for a charge of simple assault.
Payne pleaded guilty Nov. 30 to allegations that on Aug. 20, he grabbed his girlfriend, pushed her into a chair and caused redness on her body.
Michael R. Butters, 32, of Lewis Run, pleaded guilty to one count of simple assault. On Aug. 23, Butters was in a mutual fight with his adult brother, said District Attorney Stephanie Vettenburg-Shaffer. He will serve five months to one year in McKean County Jail with credit for 149 days of time served.
Andrew G. Maholic, 21, pleaded guilty to a charge of receiving stolen property and a summary charge. According to Assistant District Attorney Jerry Grill, on Dec. 21, Maholic received a stolen ladder worth $150, and he was in public while he was under the influence of a controlled substance. He will be sentenced Feb. 8.
Scott M. Debruycker, 39, of Smethport, will serve 10 days to six months in McKean County Jail and one year of probation for charges of possession of a controlled substance, possession of drug paraphernalia and a summary charge. He will serve half of the probation sentence concurrent to the jail sentence.
Morgan E. Hart, 19, of Smethport, will serve three days to six months in McKean County Jail for charges of driving under the influence of a controlled substance, possession of drug paraphernalia and a summary charge.
David C. Pfaff, 46, of Rew, was accepted into the Accelerated Rehabilitative Disposition program for driving under the influence of alcohol.
