SMETHPORT — President Judge John Pavlock rejected the guilty plea Thursday of a Bradford man who pleaded guilty to Dec. 21 to a charge of receiving stolen property.
Dennis M. Fuino, 58, not only pleaded guilty in the receiving stolen property case Dec. 21, but was also sentenced in a separate robbery case to a term of 10 to 20 years in state prison.
Sentencing on the receiving stolen property charge was set for Thursday. The plea agreement had called for a term of incarceration to be served concurrent to the robbery sentence, according to District Attorney Stephanie Vettenburg-Shaffer.
On Thursday, Fuino opted to make a statement to Pavlock prior to receiving his sentence.
According to Fuino, while he was locked up, all his personal belongings — $17,000 worth, he said — were being sold off, “not that anybody in the courtroom cares.” He did not indicate who might be selling his items.
Fuino said he was unhappy with the sentence he received for the robbery charge, saying it was more than what was outlined in the plea agreement, and said, raising his voice, that he blamed one of the probation department officials.
At that point, Pavlock interrupted Fuino. “I’m rejecting the plea,” the judge said, ordering that the case be listed for trial and that Fuino be removed from the courtroom.
Fuino struggled loudly against two sheriff’s deputies as they led him from the courtroom.
In the receiving stolen property case, Fuino is accused of receiving about 68 Zippo lighters valued at $1,953.57 between May 30 and June 9.
Shaffer noted Thursday that $1,120 was recovered, but he still owes $833.57 to Zippo Manufacturing Co. and $150 to a man he was bartering with for the lighters.
