SMETHPORT — A Smethport man was sentenced to a state prison term Thursday in McKean County Court for charges stemming from four criminal cases.
Timothy Comilla pleaded guilty in three cases on Nov. 9 and in the fourth case on Thursday and will serve 19 to 42 months in state prison, with credit for 69 days of time served. He was ordered to pay a total of $570 in restitution for the cases as well.
Comilla pleaded guilty Thursday to one charge of fraudulent traffic in food orders. According to District Attorney Stephanie Vettenburg-Shaffer, Comilla conspired with Nicole Austin to let an informant use her Electronic Benefits Transfer (EBT) card to make $350 in purchases at Walmart and pay Comilla $150.
On Nov. 9, Comilla pleaded guilty in one case to theft by unlawful taking and a summary charge, in the second case to theft by unlawful taking and in the third case to simple assault and theft by unlawful taking. He entered the plea to allegations that on Feb. 10 he took $300 from a man and kept trying to get money from him; on March 25, he took $120 from a woman; and on Sept. 1, he struck a woman in the face and took $150 from her.
Also in court, Mary F. Borza, 45, of Bradford, pleaded guilty to one count of conspiracy to deliver a controlled substance. On Oct. 4, Borza conspired with Tarence Brown for one of them to deliver about one gram of crack cocaine, said Shaffer. Borza will be sentenced Thursday.
Ronald A. Pire III, 51, of Oswayo, will serve five years in the Intermediate Punishment Program for charges of driving under the influence of alcohol and summary charges.
Joshua C. Isaman, 33, of Bradford, pleaded guilty to one count of simple assault. On Nov. 6, he hurt a 5-year-old; the next day, the side of the child’s face was red when he was seen at Bradford Regional Medical Center, said Shaffer. He will be sentenced Thursday.
Accepted into the Rehabilitative Disposition program were Brennan L. Durante, 20, of Kane, for driving under the influence of a controlled substance; and Thomas M. Vicic Jr., 31, of Emporium, and Danielle Y. Dulski, 32, of Mount Jewett, both for driving under the influence of alcohol.
