Sexual assault charges from a 2015 case against a Bradford man have been dismissed under the speedy trial rule.
Jeremy D. Clark, 42, was scheduled to appear for a jury trial Nov. 13; however, court records indicate visiting Senior Judge William Morgan dismissed the case Nov. 9 under Rule 600 — the rule stating that cases be prosecuted in a timely manner.
Clark was charged Oct. 4, 2015, with aggravated indecent assault of a person less than 16 years old, statutory sexual assault, corruption of minors and indecent assault, court records stated.
At the time, he hired private attorney Jarett Smith to represent him; however, Smith died earlier this year, and court records indicate that Douglas Garber, then an attorney in the public defender’s office, had filed paperwork on Clark’s behalf. Garber has since retired.
According to court records, Assistant District Attorney Ashley Shade filed an appeal in the case after it was dismissed. The appeal docket lists Public Defender Philip Clabaugh as Clark’s attorney.
