SMETHPORT — A Port Allegany man accused of raping a 5-year-old boy in July is in McKean County Jail.
Dwayne R. Howard, 54, of 204½ E. Mill St., was arraigned Tuesday before District Judge William Todd and held in lieu of $150,000 bail, according to court records.
Court records state that on July 11 a teenage girl saw her 5-year-old brother outside wearing only his underwear and a t-shirt; she asked him about it, and the boy allegedly told her that Howard had touched him inappropriately.
A rape kit was obtained at Bradford Regional Medical Center and sent to the Erie Regional Laboratory for DNA analysis, and Kane-based state police were called to investigate.
On Aug. 18, during an interview with a state trooper at the Port Allegany Police Station, Howard allegedly admitted to having contact with the boy and provided a DNA sample, according to court records.
Court records indicate that on Friday laboratory results came back from the State Police DNA Division that showed Howard’s DNA on samples collected from the boy.
Howard is charged with rape of a child, statutory sexual assault and involuntary deviate sexual intercourse, all first-degree felonies; aggravated indecent assault of a person less than 13 years old, a second-degree felony; corruption of minors, a third-degree felony; and indecent assault of a person less than 13 years old, a first-degree misdemeanor.
He is scheduled to appear in Central Court on Nov. 9.
Back in 2014, Howard was convicted by a jury of indecent exposure allegations.
Court records indicate he served a term in McKean County Jail for three counts each of corruption of minors, indecent exposure, open lewdness and disorderly conduct, all misdemeanors.
Court records filed at the time of the his arrested stated that on Jan. 1, 2014, Howard, who was completely naked, approached a group of three boys who were playing outside, and tried to have a conversation with them.
