SMETHPORT — Two men are in McKean County Jail following a traffic stop in Port Allegany Monday, one for his 11th arrest on driving with a suspended license relating to a DUI charge.
Thomas H. Bennett, 44, of 45 Maple St., Roulette, and Donald F. Green Jr., 57, of 81 Wilson Ave., Port Allegany, were both charged after a stop at 9:43 a.m. Friday at the Kwik Fill on U.S. Route 6 in Port Allegany.
According to court records, Friday morning, a state trooper saw Bennett driving a truck along Route 155, and knew that Bennett’s license was suspended. The trooper stopped the truck at the Kwik Fill and smelled marijuana coming from the truck. The trooper searched the truck, finding marijuana and paraphernalia inside. The trooper searched Bennett’s driving history, and court records said he had been arrested 10 times before for driving with a suspended license from DUI and four times for driving without a license.
The trooper told Green his home had been under surveillance, and Green gave the trooper permission to search it. When troopers searched, they found marijuana, mushrooms, paraphernalia, money, four long guns and one handgun. Green told police he is a convicted felon, and is prohibited from possessing firearms, court records read.
Green was charged with possession with intent to deliver, a misdemeanor; five counts of persons not to possess a firearm, first-degree felonies; and possession of a controlled substance and of drug paraphernalia.
He was arraigned before District Judge Bill Todd and remanded to jail in lieu of $175,000 bail. He is scheduled to appear in Central Court on Thursday.
Bennett was charged with possession of a small amount of marijuana and of drug paraphernalia; DUI; being a habitual offender; drivers required to be licensed; driving while license is suspended or revoked; and failing to use a turn signal.
He was arraigned before Todd and remanded to jail in lieu of $20,000 bail. He is scheduled to appear in Central Court on Thursday.
