SMETHPORT — A Smethport man accused of having indecent contact with a 16-year-old girl asked if a 2016 guilty plea can be reinstated.
Shawn M. Pire, 46, made the request Thursday in McKean County Court through his attorney, Christopher Martini.
Pire pleaded guilty on Feb. 11, 2016 — a year-and-a-half ago — to charges of corruption of minors, a third-degree felony, and indecent assault without consent, a second-degree misdemeanor.
Then, on March 2, 2017, he asked to withdraw his plea, and President Judge John Pavlock granted the request.
On Thursday, Pavlock withdrew his order granting the March 2 request, making the plea once again valid. The judge noted that Pire has been deemed a sexually violent predator, which would be considered when he is sentenced.
He is already required to register as a sex offender under Megan’s Law due to a prior conviction of indecent assault of a person who is less than 13 years of age, according to the Pennsylvania State Police Megan’s Law website.
Sentencing is set for Aug. 10.
Pavlock declined to cancel an Aug. 30 trial date until after Pire is sentenced.
At the time Pire first entered his plea, District Attorney Stephanie Vettenburg-Shaffer said he was pleading guilty to allegations that he grabbed the hands of the victim, pulling her closer to him to kiss, and he put his hand up her shirt and grabbed her bare breast.
Also on Thursday, Pire had been scheduled for a last day to plea conference in a second pending case, but the conference was continued to Aug. 31.
In this second case, he is charged with failure to provide accurate registration information for allegedly making a Facebook page under the name “Mike Pire” that he did not register with state police, according to court records. He posted $10,000 bail in the case.
