SMETHPORT — A summary trial scheduled for a former Bradford City police officer accused of retail theft that was scheduled for Monday has been postponed.
Shayne L. Miller, 45, was still employed as an officer on April 21 and April 26, the dates he allegedly stole packages of meat worth between $4.50 and $5 from Walmart in Foster Brook, according to court records.
Since that time, he has been terminated from his position in the police department.
Miller faces one count of summary retail theft in two cases — one case for each theft, court records indicate. He was scheduled to appear for a summary trial for both cases on Monday before District Judge William Todd in Smethport, but the trial was continued.
The case was initially filed at District Judge Richard Luther’s office in Foster Township, but it was transferred due to the working relationship between Luther and Miller.
The charges were filed by Kane-based state police, and the state attorney general’s office is prosecuting the case. J. Timothy George of Erie is listed in court documents as Miller’s attorney.
No new trial date was set as of Monday afternoon.
