KANE — One criminal charge against a Kane man was withdrawn on Monday, while the remaining charges in the case were bound to McKean County Court at a preliminary hearing before District Judge David Engman.
Robert W. Duck Jr., 38, still faces charges of simple assault, recklessly endangering another person and strangulation, all second-degree misdemeanors; and summary charges of harassment and public drunkenness, court records stated.
Meanwhile, a felony charge of aggravated assault was withdrawn, court records indicate.
Court records indicate that Duck was not present for the preliminary hearing and that a request for a bench warrant was issued. He was incarcerated on $20,000 bail from May 22 to June 19, when he was released on $5,000 unsecured.
According to court records, at 2:30 p.m. May 12, Duck and Ronald Jordan, 49, of Kane, arrived at the Kane state barracks to report an altercation they were in on Forest Road 122 in Lafayette Township.
Police said an argument between the pair turned physical, and Duck allegedly punched Jordan in the right temple and began choking him.
Jordan was driving at the time he was punched, court records stated.
The pair arrived at the station together, but Duck fled the station on foot — then was quickly stopped by troopers on U.S. Route 219 and taken back to the station, according to court records.
Jordan, who is facing charges of driving under the influence of alcohol for the alleged incident, waived a preliminary hearing on the charges on Monday. He is free on $2,500 unsecured bail.
