Bradford woman Amber McKinney has waived her preliminary hearing on charges alleging she had a part in the drug-overdose death of a Driftwood man at her residence in October.
McKinney, 35, of Rockland Avenue, faces charges including a drug delivery that results in death, and involuntary manslaughter for the Oct. 14, 2016, death of Derek Edward Michael Clay, 25. She waived her hearing in McKean County Central Court on Thursday.
Also charged in the death was Roberto Hernandez Perez, 56, of 117 High St. Perez is accused of delivering a fentanyl patch that was ingested by Clay. Perez is scheduled to appear in McKean County Central Court June 15.
According to court records, police were called to McKinney’s residence on Oct. 14 to assist paramedics with a call for a 25-year-old male in cardiac arrest. Police found Clay dead on the floor in the front living room area.
The couple informed police that McKinney called them, frantic, and asked the woman to come over. When the woman arrived, McKinney let her in and she saw Clay on the couch, “obviously dead and had been dead for quite some time,” court records read.
She called her husband to assist her, she told police. McKinney then “jumped up onto the couch, next to Clay and began pulling his arm, telling her to help get him out of the house,” the court records read.
The woman said McKinney wanted her to help “drag Clay out of the house and put him in his vehicle, so it would look like he died in his car,” the records read.
Then McKinney said she was going to leave, and asked the woman to say she’d been the one who found Clay. The couple attempted CPR on Clay, but were unable to revive him, court records read.
Police subsequently learned that McKinney and Clay had been dating, and he had been at her house for a few days. McKinney allegedly told police she had a “significant history of abusing prescription medications and illegal substances,” court records allege, including ingesting transdermal fentanyl patches.
She told police she got the patches from Perez on four separate occasions in October, and each happened at his residence on High Street. She said she would either leave money or perform sexual favors for the patches, according to court records.
She would take the patches back to her house and cut them into slices, she told police. McKinney told police she shared a patch with Clay at 11:40 p.m. Oct. 13, and Clay laid down on the couch after ingesting it. She discovered his body hours later in the same position, court records read.
Police searched Perez’s residence and found 20 patches of a strength 50 mcg/hour; and three prescriptions for patches, court records allege.
McKinney is being charged with drug delivery resulting in death, a first-degree felony; delivery of a controlled substance, a felony; four counts of conspiracy to deliver a controlled substance, felonies; involuntary manslaughter, a first-degree misdemeanor; two counts of recklessly endangering another person, second-degree misdemeanors; four counts of possession of controlled substances, misdemeanors; and tampering with physical evidence, a second-degree misdemeanor.
She is jailed on $500,000 bail in this case and is represented by the McKean County Public Defender’s office.
Perez is charged with drug delivery resulting in death, a first-degree felony; four counts each of possession with the intent to deliver a controlled substance and conspiracy to deliver a controlled substance, all felonies; one count of involuntary manslaughter, a first-degree felony; and three counts of recklessly endangering another person, all second-degree misdemeanors, court records stated.
He is jailed in lieu of $500,000 bail. He is represented by attorney Christopher Martini of Ridgway.
A third person is facing a charge in connection with the case as well. Perez’s wife, Robin L. Perez, 46, of Bradford, is incarcerated on allegations that she intimidated a witness in an investigation in February.
She is charged with one count of intimidation of a witness, a second-degree misdemeanor, and is incarcerated in McKean County Jail in lieu of $25,000 bail, court records stated.
According to court records, on Feb. 28 in Walmart, Perez told a woman she would hurt someone if the woman told police anything about her or her husband’s involvement in a drug overdose death. Perez allegedly told the woman to go to the police station and “fix” it, court records read.
A last day to plea conference is scheduled for June 29 in McKean County Court. She is represented by attorney Ray Bulson.
