KANE — A Kane man has been charged with allegedly altering a prescription to get six times the amount of Xanax than had been prescribed for him.
Zachery Malobicky, 19, of Edgar James Street, is charged with obtaining a controlled substance by misrepresentation, a felony; possession of a controlled substance, a misdemeanor; and forgery, a first-degree misdemeanor.
According to court records, Malobicky was given a prescription for 20 alprazolam at a strength of 1 mg, which is the generic for Xanax. However, when he took it to St. Marys Pharmacy to be filled, he had changed it to read 120 milligrams. When interviewed by police, he admitted to changing it, saying he needed the medication for anxiety, court records read.
He was arraigned before District Judge David Engman in Kane and released on $10,000 unsecured bail. He is scheduled for Central Court May 25.
Two waive hearings on alleged welfare fraud
A Bradford pair waived preliminary hearings Thursday in McKean County Court on allegations of welfare fraud.
Elizabeth Tucker, 36, and John Lichtenberger, 48, both of 13 Rochester St., were charged with fraudulently obtaining food stamps.
According to court records, between August 2013 and February 2016, the two collected $3,310 in food stamps while failing to report the entirety of Lichtenberger’s income.
Tucker is represented by the McKean County public defender’s office, while Lichtenberger is represented by attorney Christopher Martini of Ridgway.
