SMETHPORT — An inmate at the Federal Correctional Institution-McKean was convicted Tuesday in McKean County Court of possessing drugs that were smuggled in to him.
Josean Reyes-Pagan, 36, from Puerto Rico, was found guilty by a jury of all four charges against him, according to District Attorney Stephanie Vettenburg-Shaffer.
The charges against Pagan were possession with the intent to deliver a controlled substance, a felony; conspiracy to possess contraband and possession of contraband, both second-degree felonies; and possession of a controlled substance, a misdemeanor, according to court records.
Shaffer prosecuted the case, while Pagan was represented by attorney Robert Kinnear.
Court records filed at the time he was first arrested indicated that on June 19, prison personnel observed a visitor, Jennifer Oliva, 20, of Greensboro, N.C., attempt to deliver a controlled substance to Pagan — who was an FCI-McKean inmate at the time — during the prison’s visiting hours. Security footage showed her falling intentionally into his lap, then he could be seen putting items in his pant pocket and socks or shoes.
When he was confronted, prison personnel found that he had 34 packets of packaged Suboxone strips on him, court records stated.
No sentencing date for Pagan was available on Tuesday.
For her part in the incident, Oliva pleaded guilty in October to charges of possession with the intent to deliver a controlled substance and endangering the welfare of children. She entered the plea to allegations that she brought her young child with her when she delivered suboxone to an inmate at FCI-McKean.
She was sentenced Nov. 10 to one to two years in state prison with 145 days of credit for time served and 18 months of probation.
Pagan was serving time in federal prison for his part in a huge drug trafficking ring in San Juan, Puerto Rico, where 114 were charged with possessing with intent to deliver more than one kilogram of heroin; five kilos of cocaine; 1,000 kilos of marijuana; and Percocet and Xanax, all within 1,000 feet of a public school.
An online inmate locator for the Federal Bureau of Prisons indicates that Pagan is currently incarcerated at FCI-McKean and is scheduled to be released from federal custody on Oct. 28.
