SMETHPORT — A McKean County man was resentenced Friday to at least five-and-a-half years in state prison on a 2011 charge involving the sexual assault of a juvenile.
Allen York, 25, had been serving a sentence of 10 to 20 years on charges including involuntary deviate sexual intercourse and indecent assault. York had filed an appeal of the sentence, saying the mandatory minimum 10-year sentence had been ruled unconstitutional by the U.S. Supreme Court.
The state Superior Court agreed, and remanded the case back to McKean County for resentencing.
The sentence imposed on Friday was for 66 to 140 months in state prison. York has been incarcerated since March 2012.
According to court records, York was charged for an incident June 25, 2011, when he was 19. He had sexual contact with a 15-year-old boy, and then told the boy that if he told anyone what happened, he would hurt him, court records read.
