A Kane man was placed in McKean County Jail Tuesday on allegations he possessed a firearm illegally.
Matthew Joseph Calloway, 30, of 216 Johnson Road, was arraigned before District Judge Richard Luther on charges of person not to possess/use firearms-delinquent, a second-degree felonY, and firearms not to be carried without a license, a third-degree felony, court records stated.
According to court records, at 10:02 p.m. Monday, Bradford City Police were called on a report that a man brandishing a pistol was looking for Jeff Morton.
With information that was provided to them, police located the man — allegedly Calloway — by his pickup truck in the parking lot of the Best Western. When police asked him if had weapons with him or if he had a permit to carry a firearm, Calloway answered no to all questions, court records indicated.
Officers searched the truck from the outside with a flashlight and allegedly saw a pistol located between the driver’s seat and center console. Calloway then told police he knew the pistol was there, but it was not his, court records stated.
Later, during an interview with police at the city police station, Calloway explained that he took the firearm from a locked box at the camp he shares with his mother in Kane, and he “brought it with him for personal protection from Jeff Morton, who assaulted and broke his nose two days prior,” court records read. He told police that “if Morton attacked him again he would probably shoot him in the leg or something.”
No charges were filed against Morton as of Tuesday evening.
Calloway is not allowed to carry a firearm because of his criminal record, which includes a 1999 burglary adjudication he received as a juvenile, a 2011 conviction for felony retail theft and an active protection from abuse order, according to court records.
Calloway was committed in McKean County Jail in lieu of $25,000 bail, and he is scheduled to appear in Central Court on March 30.
