SMETHPORT — A Bradford man was sentenced to a state prison term Thursday in McKean County Court for charges in two separate cases.
Gregory P. Benavidez Jr., 23, had previously pleaded guilty to a charge of statutory sexual assault in one case and a charge of possession of drug paraphernalia in the second. He will serve one to two years in state prison with credit for 236 days of time served. He will also have to register as a sex offender under Megan’s Law for 25 years.
Benavidez pleaded guilty March 9, agreeing that between January 2016 and June, he had sexual contact with a female more than eight years younger than him.
Also in court, Charles M. Johnson, 35, of Bradford, was sentenced to one to two years in state prison with credit for 426 days of time served and two years of probation for charges in three cases. He is charged in one case with theft of leased property, in a second case with flight to avoid apprehension and resisting arrest and, in a third case, with simple assault.
Johnson entered a guilty plea on Feb. 16 to allegations that on Feb. 6, 2015, he treated a PS4 PlayStation Bundle he leased from Rent-A-Center as his own; on Oct. 7, 2015, he ran from a police officer who was trying to arrest him, causing the officer to use substantial force in order to carry out the arrest; and on Nov. 6 he hurt Jeffrey Morton during a mutual struggle at McKean County Jail.
Misty R. Mihalko, 31, of Bradford, was sentenced to six months to five years in McKean County Jail with credit for 103 days of time served and one year of probation for drug-related charges in three cases. She was charged in one case with possession of crack cocaine, in a second case with possession of drug paraphernalia and in a third case with driving under the influence of alcohol and possession of 29 Adderall pills and two OxyContin pills.
Laura M. Ludwig, 34, of Bradford, will serve five years in the Intermediate Punishment Program for charges of endangering the welfare of children, driving under the influence of a controlled substance and a summary charge. President Judge John Pavlock explained in court on Thursday that Ludwig had passed out in a Tim Hortons restaurant, leaving a 4-year-old child in a vehicle.
Scott F. Graves, 56, of Gifford, will serve eight to 23½ months of incarceration for a charge of simple assault. Robert Kinnear, Graves’ attorney, explained the incident occurred because of a love triangle between Graves, his girlfriend and another man. When Graves was first arrested, he had been accused of having a firearm during the incident, but District Attorney Stephanie Vettenburg-Shaffer said on Thursday that the facts to which Graves pled guilty did not involve a weapon.
Tiffany L. Osborne, 35, of Duke Center, was sentenced to four days to six months in McKean County Jail and 18 months of probation for charges in two cases. She’s charged in one case with corruption of minors and three counts of theft by deception, and she’s charged in the second with four counts of theft by deception. Osborne pleaded guilty Jan. 5 to allegations that from July 24 to 26 and from Aug. 24 to 29, she pretended to be selling pizzas for a benefit for a local man injured in an accident, taking a total of $132 from seven people; she also had a juvenile female aid in the crime by making phone calls to some of the victims.
Jason M. Musolino, 30, of Bradford, will serve 15 days to 18 months in McKean County Jail with credit for nine days of time served for charges of simple assault and resisting arrest. On Jan. 3 Musolino choked a woman, then, when police tried to arrest him, he resisted, necessitating that police use a Taser to arrest him, according to allegations he pleaded guilty to on Feb. 16.
Colby E. Lyle, 36, of Sheffield, will serve 12 days to six months in McKean County Jail with credit for 12 days of time served and one year of probation for a charge of recklessly endangering another person and summary charges. Lyle pleaded guilty Feb. 16 to allegations that on May 1, Lyle was arguing with a woman while operating a vehicle and struck another vehicle; an infant girl was also in his car at the time of the crash
Krystle L. Causer, 32, of Kane, will serve two years of probation for a charge of theft by unlawful taking in one case and charges of retail theft in three other cases.
Kasey M. Chittester, 33, of Kane, will serve 18 months of probation and pay $2,929 in restitution for a charge of welfare fraud.
Chance M. Gray-Foster, 21, of Bradford, will serve 18 months of probation for charges of criminal mischief, recklessly endangering another person and a summary charge.
Robert L. Hamilton II, 26, of Port Allegany, will serve 45 days to six months in McKean County Jail for a charge of possession of drug paraphernalia.
Shannon E. Shroyer, 47, of Eldred, will serve three to six months of incarceration with credit for 166 days of time served for charges of driving under the influence of alcohol and summary charges.
William M. Goodliff II, 39, of Shinglehouse, will serve six months in the Intermediate Punishment Program for a charge of driving under the influence of alcohol or a controlled substance and summary charges.
Jefferey L. Fox, 47, of Cogan Station, will serve six months in the Intermediate Punishment Program for charges of driving under the influence of alcohol and a summary charge.
David P. Peterson, 47, of Kane, will serve nine months of probation for a charge of disorderly conduct and a summary charge.
